These Terms bound your use of Saline Journal™ and any other Saline Journal or d2 Saline services or content you access. Saline Journal is a wholely owned property of d2 Saline, and references to “Saline Journal” and “d2 Saline” may be used interchangeably in this Agreement.
By accessing or using Saline Journal in any way you agree to be legally bound by these Terms and Saline Journal Privacy Policy. You further agree that you are legally permitted to use this site. If you do not fully agree to these Terms, do not access or use Saline Journal. [1]
d2 Saline may change the terms of this Agreement at any time, in any way, without notice. You agree to be bound by all changes in effect at the time of said use.
The content of Saline Journal includes all text, photographs, graphics, data, layout, taxonomy, layout, marks, techniques, goodwill, marketing, related social media and eMail, affiliated service providers, and all other intellectual property, and remains proprietary to d2 Saline and its licensors. Saline Journal is a trademark of d2 Saline.
Information that you provide to us or which we otherwise obtain about you will be used in accordance with our Privacy policy.
Saline Journal content is the property of d2 Saline, and, in other applicable circumstances, other rights holders. All rights are retained, without qualification, by their respective rights holders. Your use of Saline Journal is limited to personal, non-commercial use only.
Without prior written permission, you are prohibited from storing, posting, creating derivitive materials from, or otherwise archiving Saline Journal content. You may not reproduce, transmit, distribute, sell, publish, post, broadcast, frame, or by other means redirect Saline Journal content.
You agree to pay and authorize d2 Saline to assess license fees against you licensing fees in any instance where you use Saline Journal content without prior written permission.
You may include small portions of Saline Journal content in reference materials, provided that all such uses include clearly presented and specific reference of d2 Saline as copyright holder. You may also appropriately “share” references to Saline Journal through social media and eMail or similar on an article-by-article basis.
We are under no obligation to store material provided to us by third parties, nor to remove remove or delete any such material for any reason. We may remove any material from Saline Journal, at any time without notice.
We do not guarantee the accuracy of any Saline Journal content.
We do not endorse any third party content, provider, advertiser, sponsor or user content. We may link to, reference, or promote websites, applications and/or services from third parties. You agree that we are not responsible for, and do not control such websites, applications or services, nor are we responsible for the accuracy, maintenance, or routing of any link on Saline Journal. We run paid advertisements and sponsorships from third parties on Saline Journal. Any dealings you have with any of them are solely between you and those third parties.
Saline Journal content is provided for informational purposes only.
You understand and agree that Saline Journal does not recommend any security, financial product or instrument, nor does mention of a particular security on Saline Journal constitute a recommendation for you to buy, sell, or hold that or any other security, financial product or investment. Saline Journal does not provide tax, legal or investment advice.
Saline Journal is not liable for any errors, inaccuracies or delays in access to Saline Journal or its content, nor for any actions taken by you in reliance thereon.
You expressly agree that your use of Saline Journal and/or d2 Saline content is at your sole risk.
Neither d2 Saline nor its agents, principals, and licensors warrant the accuracy, completeness, currentness, noninfringement, merchantability or fitness for a particular purpose of anything available through Saline Journal.
Neither d2 Saline, nor any of its agents, principals, or licensors shall be liable to your or anyone else for any loss or injury caused in whole or in part by d2 Saline negligence or contingencies beyond its control in delivering Saline Journal content.
In no event will d2 Saline, its agents, principals, or licensors be liable to you or anyone else for any decision or any action taken by you or anyone else in reliance upon anything provided through this Saline Journal, including any consequential, special, or similar damages, even if advised of the possibility of such damages.
You agree that the liability of Company, its agents, principals, and licensors, if any, arising out of any kind of legal claim (whether in contract, tort, or otherwise) in any way connected with d2 Saline or the information in Saline Journal shall not exceed the amount, if any, that you paid to d2 Saline for use of Saline Journal.
You agree that your access to and use of Saline Journal content is on an “as is” and “as available” basis.
d2 Saline specifically disclaims and representations or warranties, expressed or implied, including and without limitation warranties of performance, merchantability, fitness for use, accuracy, completeness, reliability, and non-infringement. d2 Saline disclaims all responsibility for any loss, injury, liability, or damage of any kind resulting from or related to access or non-access to Saline Journal.
By posting or submitting content of any kind and in any form to Saline Journal, you represent and warrant that you own or otherwise have sufficient rights to said content, that the said content is accurate, that it does not violate this agreement or any applicable law, and that it will not violate the rights of any person or entity.
You further grant d2 Saline a non-exclusive, royalty-free, perpetual, irrevocable license and right to publicly display, distribute, reproduce, modify, translate, edit, create derivative works and use such user content throughout the world in any media solely as part of the features of Saline Journal (including as an incidental part of d2 Saline advertising or marketing). Saline Journal use of such content does not influence Saline Journal content elsewhere.
This agreement is between d2 Saline and you, and you may not assign your rights or obligations to anyone.
If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect. The Privacy Policy and this agreement are, together, the complete and entire agreement between you and d2 Saline, and supercedes any prior agreement, whether oral or written.
This agreement, all intellectual property issues, and your rights and obligations shall be governed by the laws of the United States of America and the State of Michigan governing contracts wholly entered into and wholly performed within Michigan and any action to enforce this agreement or in any manner related to the Service shall be brought exclusively in the federal or state courts located in Detroit Michigan, and you agree to submit to the jurisdiction of such courts. You agree to be responsible for any damages resulting from your breach of this Agreement and reimburse d2 Saline for all of costs, expenses and fees (including all attorney’s fees) arising from or relating to your breach.
If you believe that your work has been copied and is accessible through Saline Journal in a way that constitutes copyright infringement, or that Saline Journal contains a link or other reference to another online location that contains materials or activity that infringes on your copyright rights, you may notify d2 Saline by providing the information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. § 512 through the Saline Journal Contact page.
